DEKALB WINNING HAS ROOTS SCHOLARSHIP OFFICIAL RULES

The DEKALB Winning Has Roots Scholarship program (the “Program”) is sponsored by Monsanto Company, a member of the Bayer Group, and administered and managed by the National FFA Organization (“National FFA”). Winning scholarship applications will be judged and selected by National FFA from a pool of eligible applicants based on criteria set out at FFA.org/scholarships (the “FFA Website”) and based on eligibility requirements set out at the FFA Website and below. For full details regarding the number of awards, entry period, submission requirements and scoring criteria, please visit the FFA website. Additional details regarding eligibility and additional terms and conditions of the Program are below. Please review the FFA website frequently for up-to-date information.

1. Sponsor & Administrator: 

The sponsor of the Program is Monsanto Company, a member of the Bayer Group, 800 North Lindbergh Blvd., St. Louis, Missouri 63167 (“Sponsor”).

The organization administering the program is National FFA Organization, a 501(c)(3) nonprofit organization, 6060 FFA Drive, Indianapolis, IN, 46268 (“National FFA”).

2. Program Entry Period:

Applications for the Program must be received between 12:00 a.m. Eastern Time on October 26, 2020 and 11:59 p.m. Eastern Time on January 14, 2021 (the “Program Entry Period”).

3. Eligibility:

Student Eligibility – The Program is open to students who are: 1) current members of the FFA in the United States; 2) are high school seniors (public, private or homeschool) entering his/her freshman year in Fall 2020 or full-time college students entering his/her sophomore, junior or senior year in Fall 2020 (enrolled in a minimum of 12 credit hours); 3) have at least a 3.0 GPA at the time the application is submitted; 4) agree to the terms of these Official Rules; and 5) meet any and all other eligibility requirements set out on the National FFA website. In addition, applicants must be pursuing or demonstrate an intent to pursue an agriculture-related major/degree in agribusiness systems, biotechnology systems or plant systems from a two- or four-year higher education program.

Individuals Not Eligible to Participate – The following individuals are not eligible to participate in the Program: (1) officers, directors, and employees of Sponsor or National FFA, or of any of its representatives or advertising/promotion agencies, or any of their spouses/domestic partners, children, or household members; (2) officers, directors and employees of Sponsor, National FFA, or of any of its subsidiaries or affiliates, or any of their spouses/domestic partners, children, or household members; and (3) officers, directors and employees of any seed dealer, or any of their spouses/domestic partners, children, or household members.

4. How to Apply for a Scholarship:

The Program scholarship application is administered by the National FFA. Eligible students must visit FFA.org/scholarships to complete the application during the Program Entry Period.

All applicants are required to complete all registration information (including, without limitation, your name, address and other contact information). All applications must be completed within the Program Entry Period to be eligible to win. Any applications received after the end of the Program Entry Period will not be accepted. All applications become the property of the National FFA and will not be acknowledged or returned.

Limit one application per person.  Applications in excess of this limit are void.

5. Scholarship Award:

Students from all counties in the United States are eligible to participate. There will be one scholarship awarded from among all entrants chosen by the National FFA. The minimum amount of the scholarship is $6,400.  The amount will be increased based on Clint Bowyer’s participation in and performance at the NASCAR Cup Race at Kansas City Speedway to be held on October 18, 2020.  For every lap completed in the No. 14 DEKALB car, the amount of the scholarship shall increase by $14 (up to $10,138 if all 267 laps are completed).  Further, if Clint Bowyer is the winner of the race, the total amount of the scholarship shall be increased to $14,000.  Check the FFA website for the final value of the scholarship after the completion of the race on October 18, 2020.

In the event the NASCAR Cup Race at Kansas City Speedway cannot be held due to an ongoing pandemic or other event outside of Sponsor’s or the National FFA’s control, the value of the scholarship will be $6,400..

Program scholarships are not transferable. No substitution of Program scholarship or any portion thereof is allowed, except at the sole discretion of the Sponsor.  Program scholarships may only be used toward college tuition during the Fall 2021 - Spring 2022 school year. Program scholarships have no retail value.

6. Conditions of Participation:

By participating in the Program, each applicant agrees as follows: (1) to be bound by these Official Rules which are final and binding in all respects, and to comply with all decisions of the National FFA with regard to the administration of the Sweepstakes and these Official Rules, its interpretation or application; (2) that he or she meets all the eligibility requirements under these Official Rules; (3) to comply with all applicable laws and regulations; and (4) that Missouri law, without regard to its conflict of laws principles, shall apply exclusively to the Program and Official Rules and that any dispute with respect to the Program and/or these Official Rules shall be resolved in either the federal or state courts located in the State of Missouri, County of St. Louis.

By participating in the Program, each applicant also, except where legally prohibited, without additional compensation: (1) grants permission for the National FFA, Sponsor, and those acting pursuant to their s direction, to use his or her name, hometown name, picture, portrait, likeness, voice, biographical information, and comments made in connection with the Program in any and all advertising and promotional materials, worldwide, and/or on the Internet, including social media, relating to the Program, and similar programs which may be offered by the Sponsor and/or National FFA; (2) waives any right to review or approve any such use; (3) agrees that the Sponsor and National FFA may make slight stylistic modifications to his or her comments, which do not materially alter the original meaning; (4) agrees that all media or other materials created by the Sponsor and/or National FFA are the property of the Sponsor or National FFA (as applicable), including but not limited to any copyright therein; (5) agrees that the release of information about winners, including dissemination to the public and media through any channels, may be made by the Sponsor and/or National FFA; and (6) releases the Sponsor and National FFA from any and all claims for libel, copyright, invasion of privacy or rights of publicity pertaining to such use.

7. Use of Information:

Data collected by the National FFA from scholarship applications will be shared with the Sponsor and will include applicant’s name, hometown mailing address, email address and phone number. Please see FFA.org website for more information regarding the National FFA’s privacy policy.

Contact information provided to the Sponsor will be used by the Sponsor, and those acting on behalf of the Sponsor, to communicate with applicants regarding the Program. This information may include, but is not limited to, name, address, phone number and e-mail address.  Such information will be treated in accordance with these Official Rules and Sponsor’s Privacy Policy (as may be amended from time to time), currently located at https://www.bayer.com/en/privacy-statement; provided, that in the event of any conflict between these Official Rules and such Privacy Policy, the terms and conditions of these Official Rules shall prevail only with respect to the conduct of this Sweepstakes.

8. General:

Neither the National FFA nor the Sponsor is responsible for: (a) any typographical or other errors in the printing or offering of this Program, or in the description of any Program scholarship or in any other materials produced in connection with the Program; (b) lost, garbled, misrouted, damaged, distorted, late, stolen or misdirected entry forms, whether submitted online or by mail; or (c) disruptions or interruptions of the Program due to intervening factors outside the control of National FFA or Sponsor. To the extent there is any conflict between any communications and/or materials regarding the Program or any Program scholarship, and the Official Rules, the Official Rules will control.

Uses of automated devices are not valid for submission of applications and will subject the user to immediate disqualification.

Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Program. In the event of termination of the Program, a notice will be posted online.

Applications that do not comply with these Official Rules will be disqualified. The National FFA and the Sponsor each  reserve the right in its sole discretion to disqualify any entry at any time which, in its opinion, is offensive, contains unsuitable material, threatens the safety or wellbeing of any applicant, or if it is determined that the applicant has not complied with these Official Rules. Further, the National FFA and/or Sponsor may disqualify any person based upon suspected fraud, dishonesty, violation of rules or other misconduct. Applicants must comply with all rules as published.

The Program is subject to all applicable federal, and/or state rules and regulations and is void where prohibited by law.

9. Taxes:

The scholarship may be considered taxable income, and the recipient will be solely responsible for any federal, state, and local taxes.  Winner will receive an IRS 1099 form reflecting the amount they receive as a Prize.

10. Social Media

The Program may be advertised or administered through social media platforms, such as Facebook and Instagram (“Social Media”).  You understand and acknowledge, however, that the Program is in no way sponsored, endorsed, administered by, or associated with any Social Media platform on which it is offered or advertised, including Facebook and Instagram.  You agree to adhere to all rules established by Social Media platforms and will not create multiple Social Media accounts, or repeatedly post duplicate or near duplicate information or links to enter into the Program multiple times.  Any information you provide for the Program is being provided to National FFA/Sponsor rather than Facebook or any other Social Media platform.  You fully release Facebook and all other Social Media from all claims, losses and harm that you may allege or incur relating to this Promotion.

11. LIMITATION:

ALL SCHOLARSHIPS ARE AWARDED "AS IS" WITH NO GUARANTEE, REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED.  NATIONAL FFA AND SPONSOR DISCLAIM ANY IMPLIED WARRANTIES OR GUARANTEES.

RELEASE AND HOLD HARMLESS.  BY ENTERING THIS PROGRAM, YOU AGREE TO RELEASE AND HOLD HARMLESS NATIONAL FFA, SPONSOR, THEIR PARENTS, SUBSIDIARIES AND AFFILIATED ENTITIES, AND EACH OF THEIR DIRECTORS, OFFICERS, EMPLOYEES, ATTORNEYS, AGENTS, AND REPRESENTATIVES (“SPONSOR REPRESENTATIVES”) FROM ANY DAMAGE, INJURY, EXPENSE, COST, DEATH, LOSS, CLAIM, ACTION, DEMAND, OR OTHER LIABILITY THAT MAY ARISE IN CONNECTION WITH THE PROGRAM, OR RESULTING FROM ACCEPTANCE AND/OR USE OF ANY SCHOLARSHIP MONEY, TRAVEL TO OR FROM ANY PROGRAM-RELATED ACTIVITY, PARTICIPATION IN THIS PROGRAM.  YOU FURTHER AGREE TO INDEMNIFY AND HOLD HARMLESS THE SPONSOR REPRESENTATIVES FROM AND AGAINST ANY CLAIMS THAT ARISE (DIRECTLY OR INDIRECTLY) FROM YOUR ACTIONS OR YOUR BREACH OF THESE OFFICIAL RULES.

12. Disputes: 

Any and all disputes, claims, and causes of action arising out of or connected with the Program or any scholarships awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in federal or state court located in the City and County of St. Louis, Missouri.  Any and all claims, judgments and awards of damages relating to the Program and any damages awarded will be limited to actual out of pocket costs incurred in entering the Program, but shall not include attorneys' fees or costs incurred in bringing a cause of action.
